The agreement between you and us, including who may use the app

These terms
These are the terms on which you may use ByeThings. By creating an account you agree to them. If you do not, please do not create one.
ByeThings is a trading name of Tomo Interactive Ltd, a company registered in England and Wales under company number 17045564, whose registered office is at 1 Richmond Road, Lytham St. Annes, England, FY8 1PE.
They are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts. Nothing here removes rights you have as a consumer that cannot be removed by agreement.
You must be 18 or older
You must be at least 18 years old to hold an account. Selling to and buying from strangers involves agreeing terms, handling money and sometimes meeting in person, and that is not something we are willing to ask a child to do unsupervised.
If you are under 18, you may use ByeThings only where a parent or legal guardian has given permission, holds or supervises the account, and accepts these terms on your behalf. That adult is responsible for everything done through the account.
We may ask you to confirm your age, and we may suspend an account we reasonably believe belongs to someone under 18 using it without permission. If you believe a child is using the app unsupervised, tell us at contact@tomointeractive.com.
Your account
One account per person. Keep your password to yourself; you are responsible for what happens through your account unless you have told us it has been compromised.
Give us accurate information, and keep it current — particularly your address, since it is what a parcel is sent from and returned to.
You can close your account at any time, from Profile, and doing so deletes it and its contents rather than merely hiding them. We may suspend or close an account that breaks these terms, that is being used to harm someone, or where we are required to by law. Where it is reasonable to do so we will tell you why and give you a chance to respond.
We are the venue, not the seller
ByeThings is a place for people to advertise things and find each other. The contract of sale is between the buyer and the seller. We are not a party to it, we do not own the items, and we do not take possession of them.
That means we cannot guarantee that an item is as described, that a seller will send it, or that a buyer will pay. We will help where we can, but the agreement is yours.
Because sales are between private individuals, consumer rights that apply when buying from a trader — such as the right to change your mind under the Consumer Contracts Regulations — generally do not apply. They do apply where the seller is acting as a business.
Selling as a business
If you sell in the course of a business — buying to resell, trading at volume, or otherwise acting commercially rather than clearing out your own belongings — additional obligations apply to you, not to us.
You must identify yourself as a business seller, comply with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 including the 14-day right to cancel, and meet your own tax and record-keeping obligations. You are responsible for determining whether you are trading.
We may require proof of business status, and we may remove listings where a business seller has not identified themselves as one.
What you may not list
Do not list anything you may not lawfully sell, or that we have told you not to. This is not an exhaustive list, and we may remove anything we reasonably consider unsafe or unlawful.
Counterfeit goods, or anything infringing somebody else's trade mark or copyright.
Weapons, ammunition, explosives, or anything designed to cause injury.
Drugs, prescription medicines, tobacco, vapes, alcohol or anything age-restricted.
Stolen goods, or anything you do not own and have the right to sell.
Recalled products, or anything that does not meet UK safety standards — including electricals that are not safe to use and upholstered furniture without the required fire-safety labelling.
Personal data, accounts, tickets in breach of their terms, or financial instruments.
Anything obscene, hateful, or that would be an offence to distribute.
How you must behave
Treat the other person as somebody real. Do not harass, threaten, defraud or discriminate against anyone, and do not use the messaging service to send anything you would not want to have to explain.
Do not attempt to take conversations off the platform in order to avoid our rules, do not scrape the marketplace, and do not attempt to break, overload or work around the limits on the service.
We may read a conversation where it is reported to us or where we are investigating harm — see the Privacy Centre.
Meeting in person
If you arrange a collection, use your judgement. Meet in daylight in a public place where you can, bring someone with you for anything large, and tell somebody where you are going.
We do not vet users, verify identities or check items. Please do not treat the presence of an account as a reason to trust somebody.
Prices and the AI scanner
The scanner produces an estimate. It is a machine looking at a photograph, and it can be wrong about what an item is, what it is made of and what it is worth.
We do not compare your item against live listings anywhere else. The estimate is the model’s own reading of the photograph and your notes, which is why it is a starting point for you to change rather than a valuation.
The price is yours to set and yours to accept. Do not treat an estimate as a valuation, an appraisal or advice, and do not rely on it for insurance, probate or anything else where being wrong matters.
Scans, packs and payment
Scanning is the only thing we charge for. Publishing listings, messaging buyers and your public seller page are free and unlimited on every account, because scanning is what costs us money each time and listings do not.
A free account comes with a set number of scans, described in the app. After that you can buy a pack of scans as a one-off payment. Packs do not expire and do not renew — when you have used them, nothing further is taken unless you choose to buy again.
Where a scan fails for a technical reason, is refused, or comes back too uncertain to use, it does not count against your balance. A scan that succeeds does count, including one you are unhappy with.
We also offer an optional monthly subscription for people who list regularly. It renews until cancelled, and you can cancel at any time and keep it until the end of the period you have paid for.
Payment is taken by Apple or Google, not by us, and their refund policies apply. If you are a consumer in the UK or EU you have 14 days to change your mind about a new subscription, though that right ends once you have used the service in that period. Because a pack of scans is delivered to your account immediately, that right ends as soon as it is delivered — a scan you have already spent cannot be returned.
Prices and allowances are shown in the app before you pay and may change, with notice. A change never affects scans you have already bought.
Your content
Your photographs and descriptions remain yours. By publishing a listing you give us a licence to host, reproduce and display that content for the purpose of running the service and showing your listing to buyers. That licence ends when you delete the listing, except for copies already made by others or retained in backups for a limited period.
Only upload photographs you took or have the right to use, and make sure they do not show other people, other people's property or anything you would not want public.
Reporting a problem
Report a listing from the listing itself, or from the conversation it is about, using the menu in the corner. You can also tell us at contact@tomointeractive.com. Report illegal content, a dangerous item, a listing that infringes your rights, or somebody behaving badly, and we will look at it and act where it is warranted.
If we remove something of yours, we will tell you why and you can ask us to look again.
Blocking somebody
You can block another user from any conversation or listing. Blocking stops them messaging you or making you offers, in both directions, and their listings stop appearing in your marketplace.
We do not tell the person you have blocked them. Existing conversations stay where they are, so you keep a record of what was said and can still show it to us if you report them.
You can see everybody you have blocked, and undo it, under Blocked people on your profile.
Our liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Nothing in these terms affects your statutory rights.
Subject to that: we provide the app as it is, we do not promise it will be uninterrupted or error-free, and we are not liable for the acts or omissions of other users, for the accuracy of an AI estimate, or for loss that was not reasonably foreseeable. Where we are liable, our total liability to you is limited to the greater of the amount you have paid us in the previous twelve months or £100.
Changes to these terms
Last updated 2026-07-28. We will give you reasonable notice in the app before a material change takes effect. If you do not accept a change, you can close your account.
